Terms of Service

The contract terms that apply when you buy a service from AIOR: what we provide, how an order is formed, fees and renewal, withdrawal and refunds, the obligations of both parties, suspension and termination, limitation of liability and the remedies available to you.

Effective
2026-09-22
Basis
Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation · E-Commerce Law no. 6563 · Law no. 5651 · Personal Data Protection Law no. 6698 · TS ISO/IEC 20000-1:2018

1. Parties, Scope and Definitions

This agreement is between AIOR TECHNOLOGY LIMITED COMPANY ("AIOR") and the natural or legal person using the services ("Customer"). By placing an order on aior.com or by starting to use a service you accept these terms. AIOR's full identity and registry data are in the "Service Provider Details" section at the end of this page.

  • Service: The ordered hosting, server, domain, DNS, business e-mail, licensing, software development, maintenance, consultancy and engineering services.
  • Product page: The page shown before ordering that defines the scope, technical limits and price of the service. It forms an integral part of this agreement.
  • Consumer: A natural person acting outside their trade or profession. For consumers, Law no. 6502 and the Distance Contracts Regulation take precedence.
  • Client area: The account area where orders, invoices and support records are managed.

2. Services and Service Level

AIOR provides custom software development, web and e-commerce applications and systems integration, artificial intelligence and data analytics, cybersecurity, industrial automation and digital transformation, and IT infrastructure (servers, hosting, domains, DNS, business e-mail, licensing, backup) with technical support. The technical scope of each service is stated on the product page at order time and on the invoice.

Service hours, priority classes, response and resolution targets and availability measurement are defined in the Service Level Statement. Signed corporate contracts may set different, binding targets.

3. Order, Formation and Activation

  • The contract is formed when the order is confirmed and payment is received; the order summary and invoice are posted to the client area.
  • Hosting and licensing services are provisioned after payment verification; setup details are sent to the registered e-mail address.
  • Domain registrations are subject to the rules of the relevant registry (TRABIS/nic.tr, ICANN-accredited registries); after registration a name change or refund may not be possible.
  • Information provided by the Customer (title/name, tax or ID number, e-mail, phone, address) must be accurate and current. Orders with false or incomplete data may be cancelled; for domains, inaccurate data may lead to cancellation of the registration.
  • For project, software and engineering work, scope, delivery schedule and acceptance criteria are set out in a separate quotation or contract.

4. Fees, Invoicing and Renewal

  • Prices are published on the product page. Unless stated otherwise, prices exclude VAT; taxes are shown separately on the invoice.
  • For subscription services a renewal invoice is issued to the client area before the period ends and notified to the registered e-mail address.
  • An unpaid service may be suspended after the due date; at the end of the suspension period the service and its data may be deleted. Notice is given before deletion.
  • Domain renewals follow the registry's schedule. Recovering an expired domain may incur extra fees or may not be possible.
  • Price changes do not affect the current period; a new price applies from the next renewal period with prior notice.

5. Right of Withdrawal, Refunds and Cancellation

For distance services bought as a consumer, a fourteen-day right of withdrawal generally applies under the Distance Contracts Regulation. However, the right cannot be exercised for services that begin to be performed with the consumer's consent and are performed instantly in the electronic environment, or for the supply of intangible goods.

  • Items transmitted instantly to a third party and not recoverable — domain registration and renewal, software licences, SSL certificates — are non-refundable.
  • For provisioned hosting packages a pro-rata refund may be considered after deducting the period used and third-party costs.
  • For custom software, design, installation and engineering work, refunds are calculated after deducting completed work and incurred costs.
  • Withdrawal and refund requests are submitted by support record from the client area or by registered e-mail (KEP)/e-mail; approved refunds are made using the original payment method.
  • A subscription can be cancelled at any time so that it does not renew; cancellation takes effect at the end of the current period.

6. Customer Obligations

  • Keep account and access credentials confidential; use strong passwords and multi-factor authentication wherever available.
  • Keep own applications, themes and plugins updated and secure; keep them free of malware.
  • Comply with the Acceptable Use Policy; not use the service for unlawful content, unsolicited bulk e-mail, malware distribution or in a way that degrades others' service.
  • Keep own copies of critical data; backups taken by AIOR do not remove this responsibility.
  • Keep contact and billing details current; notices are sent to the registered e-mail address.

7. AIOR's Obligations

  • Provide the service within the scope defined on the product page and in line with the targets in the Service Level Statement.
  • Monitor the infrastructure, apply security updates and manage outages through defined processes.
  • Process customer data only to provide the service; protect confidentiality and meet obligations under Turkish data protection law.
  • Announce planned maintenance that affects the service in advance and inform customers about outages.
  • Delete customer data when the service ends, except where retention is legally required.

8. Content Responsibility and Hosting-Provider Duties

The Customer is solely responsible for hosted content. AIOR acts as a hosting provider under Law no. 5651; it is not obliged to monitor hosted content or to investigate whether unlawful activity exists.

  • Upon a duly made notice by competent authorities or rights holders, unlawful content is removed within the period prescribed by law and the Customer is informed.
  • AIOR is listed in the BTK hosting-provider registry and holds an ETBIS record.
  • Traffic and access logs are kept for the period and scope required by law and are shared only upon a duly made request by competent authorities.

9. Personal Data and Commercial Messages

  • Disclosure on the processing of personal data, your rights and how to apply are set out in the Privacy Policy.
  • Where third-party personal data is processed on systems hosted by the Customer, the Customer is the data controller and AIOR is the processor; a data processing agreement is signed where required.
  • Transactional notices about the service (invoices, outages, security) form part of contract performance. Promotional commercial electronic messages are sent only with consent under Law no. 6563, and every message offers an opt-out.

10. Suspension and Termination

  • A service may be suspended for non-payment, breach of the Acceptable Use Policy, a situation threatening the security of the service or other customers, or a decision by a competent authority.
  • For security-related suspensions, notice is given as soon as possible together with the remediation path.
  • Either party may end the agreement by not renewing at period end. If a material breach is not remedied within a reasonable time, the other party may terminate.
  • On termination or expiry the Customer may export their data within a reasonable period; thereafter the data is deleted.

11. Limitation of Liability and Force Majeure

  • Unless agreed otherwise in a signed contract, AIOR's contractual liability is limited to the fees paid for the affected service in the preceding twelve months.
  • Claims for indirect damages, loss of profit and data loss are not covered where the customer has not met their own backup obligation.
  • In force majeure events — natural disaster, fire, war, cyber attack, decisions of public authorities, widespread power or internet outages — obligations are suspended for the duration of the impediment.
  • These limitations do not affect liability arising from intent or gross negligence, nor a consumer's mandatory statutory rights.

12. Intellectual Property

  • Rights in AIOR's software, trademarks, designs and documents belong to AIOR; using the service does not transfer those rights.
  • Rights in content and data uploaded by the Customer remain with the Customer; AIOR processes them only to provide the service.
  • Transfer of rights in bespoke software developed to order is expressly set out in the relevant quotation or contract.
  • For third-party licences (operating system, control panel, add-ons) the relevant vendor's licence terms apply.

13. Changes and Notices

  • These terms may be updated; the current version is published on this page together with its effective date.
  • Material changes to the Customer's detriment are notified a reasonable time before they take effect; the Customer may then end the agreement at period end.
  • Notices are delivered to the client area and the registered e-mail address; the registered e-mail (KEP) address is used for formal notices.

14. Governing Law, Jurisdiction and Remedies

This agreement is governed by the laws of the Republic of Türkiye. For commercial disputes, Bursa Courts and Enforcement Offices have jurisdiction, subject to mandatory jurisdiction rules.

Consumers may apply to the Consumer Arbitration Committee or the Consumer Court at their place of residence, according to the applicable monetary thresholds. No provision limits this right.

Raising a support record first speeds up resolution; your request is recorded and tracked.
